Deadline Hollywood is reporting that a judge has sided with FOX over the rights to the film.
With the release of the universally panned The Spirit, will a good adaption help comic book fans ring in the early part of 2009 or not?

yes but the court case doesnt actually start until next year so I still have hope for a resolution.
