Foxs Wants Watchmen Buried

As fans wait to see how the director of the 300 translates what is thought to be one of the most profound graphic novels of all time Fox is trying to bury it. Variety is reporting that their quest just got one step closer.
It seems a judged denied a motion to dismiss the lawsuit over who really owns the rights to the film in the first place.
My question is where was Fox when the film started shooting back in September? It's not like it was a big secret.

fox waited until the film was basically in the can because they know they've got an airtight case. they don't really want to prevent the film from being released, they just want to reach a settlement with warner to net fox lots of money in order for them to allow the film to be released. by waiting until the film was in post, they know that warner has dumped a ton of money into this project already are likely just going to bite the bullet, pay fox, release the film, and hope to recoup.
this is a blip, really. if fox had sued way back in pre-production, we might not have gotten the film made at all.
If I was the judge I'd rule that Fox is just being a bunch of a-holes and dismiss the case.
But then again, that's probably why I'm not a judge.
